Terms and Conditions

Introduction

These Terms and Conditions (“Terms”) govern your use of the tour services provided by Newline Tourism Kenya (“we,” “our,” or “us”). By booking or participating in our tours, you agree to these Terms. Please read them carefully before proceeding with your booking.

Booking and Payments

Booking Confirmation:

  • Bookings are confirmed upon receipt of the required deposit as specified during the booking process.
  • A confirmation email or receipt will be provided as proof of your booking.

Payment Terms:

  • Where bank transfer or card payment are solely used as the medium, full payment is required 06 to 01 days before the tour departure date.
  • Failure to complete payment within the stipulated timeline may result in cancellation.

Payment Modes:

  • Bank Transfer: Payments can be made via bank transfer. All transfer charges are the responsibility of the sender.
  • Card Payments: Payments through our secure online payment portal are subject to a 4% transaction fee PER
  • Modified payment: The deposit amount that is required to secure accommodation reservation is paid either through bank transfer or card payment. The remaining balancemust be settled in cash, on the agreed currency, upon arrival—either during the meet-and-greet at the hotel/residence or at the airport—prior to the tour commencement.

Prices and Inclusions:

  • Prices are subject to change based on currency fluctuations, government regulations, or supplier price adjustments.
  • Tour inclusions and exclusions will be clearly stated in the tour itinerary or package description.
  • Prices may change as the itinerary changes but the client will be informed accordingly

Cancellations and Refunds

Cancellation by Customers:

In case a booking is cancelled, the following cancellation fees shall apply:

 

  • 0% cancellation fee– before 31 days prior to departure
  • 25%cancellation fee – between 30 – 20 days prior to departure.
  • 50% cancellation fee – between 19 – 10 days prior to departure.
  • 75% cancellation fee – within 9 days prior to check-in.
  • No Show – no refund.
  • Unused tours/excursions/tickets – no refund or adjustment.

NB: Refunds are subject to the policies of third-party suppliers (e.g., hotels). We will process refunds only after receiving funds from the respective suppliers.

Cancellation by Newline Tourism:

  • We reserve the right to cancel tours due to unforeseen circumstances, including natural disasters, government restrictions, or insufficient participants.
  • In such cases, customers will be offered a full refund or the option to reschedule.

Non-Refundable Components:

  • Certain components, such as visa fees, travel insurance, or some third-party services, are non-refundable.

Travel Documents and Requirements

Passports and Visas:

  • Customers are responsible for ensuring they have valid passports, visas, and other travel documents required for entry into Kenya.

Health and Safety:

  • It is the customer’s responsibility to meet health requirements, including vaccinations, as per Kenyan regulations.

Personal Data:

  • Personal information provided for bookings will be processed in accordance with our Data Privacy Policy. Customer data will not be shared with third parties except where necessary for bookings

Changes to Itineraries

Alterations by Customers:

  • Any requested changes to itineraries after confirmation may be subject to additional charges and availability.

Alterations by Newline Tourism:

  • We reserve the right to make minor adjustments to itineraries due to weather conditions, local circumstances, or supplier limitations.
  • Significant changes will be communicated in advance.

Limitation of Liability

Force Majeure:

  • Newline Tourism is not liable for delays, cancellations, or disruptions caused by events beyond our control (e.g., natural disasters, political unrest, or public health emergencies).

Third-Party Services:

  • The company reserves the right to sub-contract any part of the tour, and in the event of such sub-contract all the above terms shall apply.

Customer Responsibility:

  • Customers must behave responsibly during tours and comply with Kenyan laws. We are not responsible for any loss, damage, or injury resulting from negligence or misconduct by customers.
  • For tours operating on a shared group basis, we kindly request all guests to demonstrate courtesy and mutual consideration toward fellow travelers.
  • The tours may involve close proximity to wild animals in their natural habitat. While wildlife encounters are carefully managed, we cannot eliminate all risks inherent to wilderness environments, including potential animal interactions. Please note that many safari camps are unfenced, and wildlife may move freely through the premises. Newline Tourism Kenya and its partners cannot be held liable for injuries or incidents resulting from wildlife encounters. Guests must follow all safety instructions provided by guides and exercise caution at all times.

Travel Insurance

  • Mandatory for customers participating in our tours.
  • Must cover cancellations, medical emergencies, and personal belongings.

Photography and Media

  • By participating in a tour, you grants us the right to use photographs/videos taken during the trip for promotional purposes (website, social media, brochures).
  • If you do not wish to be featured, kindly notify us in writing before the tour.

Complaints and Disputes

  • Complaints should be reported immediately to the tour leader or our customer service team.
  • Disputes arising from these Terms will be governed by Kenyan law and resolved through litigation, arbitration, or mediation where applicable.

Updates to Terms and Conditions

  • We may update these Terms periodically. The latest version will be available on our website and apply to future bookings.
